[00:00:00] Speaker A: Imagine looking down at your phone right now and seeing a casual, routine text message from your aging mother.
For years, she has been the absolute rock of the entire family.
Independent, fiercely sharp tongued, and comfortably living hundreds of miles away in the neighborhood you grew up in.
The message on your screen seems completely normal. Maybe a little rushed or slightly brief, but nothing that rings an immediate alarm bell in your chest.
But beneath that digital screen, far away from your daily sightline, a professional financial trap is already being methodically constructed.
[00:00:39] Speaker B: Welcome to behind the Scams. Today, we are opening up the pages of a terrifyingly common script that plays out in thousands of suburban households across the country every single year.
It's a harrowing real world story, detailed in a book that was actually forwarded directly to us by the author himself.
The book is called the Caregiver's Game, written by Charles E. Wallace, Jr. Yeah,
[00:01:10] Speaker A: and I want to personally thank Charles for reaching out and sending that copy over to us.
I have to tell you, sue, upon sitting down and reading this book, it instantly triggered me back to my career as a federal special agent investigating complex financial crimes.
Reading his family's account brought back a flood of memories because a massive percentage of my active caseload involved senior citizens in one way or another.
During my time in federal law enforcement, I worked very closely with the FBI and we would regularly conduct what we called knock and talks.
These were field operations where we would follow up directly on suspicious activity reports, or SARs that were legally filed by banking institutions.
Law enforcement has direct access to this financial intelligence database, and a massive crushing majority of those SARs dealt explicitly with financial crimes or systemic predatory abuse targeting vulnerable seniors.
Oh, and before we move on to anyone out there who works for a financial institution, our. Our knock and talks were to determine if there were any underlying crimes associated with a particular suspicious activity report.
Our purpose was not to expose the bank's filing of a sar.
The filing of any particular SAR is not to be directly disclosed to any witness, subject or involved persons.
So myself and my FBI cohort would locate persons involved one way or another with the information outlined in the sar, whether it be a suspicious person accompanying someone into the bank, suspicious activity by a customer, or similar circumstances.
But sue, we didn't just knock on a door and throw a SAR in their face and say, what is this all about?
We had a little SAR dance that we did, which never really disclosed how we got the information.
[00:03:06] Speaker B: Very interesting, Nick, but you know, most people think the government is always watching them anyways, so it probably didn't raise too many Alarm bells. But Nick, it's incredible how neatly your investigative background mirrors the exact systemic failures Charles exposes in his book.
And Nick, this case isn't just a standard run of the mill look up into an isolated financial theft.
This is a deep, uncomfortable exploration of a hidden vulnerability that millions of modern busy families face. Regulation right this second.
It is a psychological blind spot that investigators explicitly refer to as the distance gap.
[00:03:51] Speaker A: Exactly, Sue. The distance gap is the ultimate force multiplier for a financial predator.
When you live several states away from an aging parent, your entire relationship inevitably begins to rely on a series of curated snapshots.
Think about how most long distance family dynamics actually work under the surface.
You have a scheduled phone call over the weekend, a quick check in text thread during the week, and maybe a physical visit during the holidays.
As adult children trying to balance our own frantic careers, kids and households, we train our minds to look for the massive, obvious warning signs of decline.
Things like sudden, drastic memory loss, physical injuries, structural damage to the home, or a completely unkempt living space.
But highly sophisticated predatory scammers don't make massive disruptive moves early on.
They don't want to startle the family network or trigger an unannounced visit.
Instead, they look for the exact physical distance you leave behind. And they step directly into that quiet vacuum.
[00:05:00] Speaker B: In the tragic case of Charles's mother, Joelle, that wide open door was discovered by an independent, unverified caregiver all the way back in 2013.
At that specific time, Joelle was just beginning to slip into the incredibly subtle early stages of dementia.
These were minor, fleeting cognitive gaps, momentary forgetfulness or slight confusion about dates that were almost impossible to detect during a routine 10 minute phone call from a few states away.
On the phone, Joelle could still rely on her sharp wit and classic humor to completely mask her vulnerabilities from her children.
But a predator operating directly inside the home recognizes those micro flaws immediately.
What followed over the next nine years wasn't just a simple case of petty theft or pocketing loose cash from a countertop wallet.
It was an industrialized, multi year psychological mind game that would take the family nearly a decade to fully uncover.
[00:06:20] Speaker A: When physical distance separates a family, you aren't just fighting the fraudster.
You are actively fighting the illusion that everything is completely fine just because the weekly phone calls sound normal.
Over the course of this massive two part episode of behind the Scams, we are going to unpack exactly how that dangerous illusion is manufactured by a criminal. How the legal systems designed to protect our loved ones completely Fail. And how a family can build a bulletproof defensive shield before the trap springs shut lets dive into the opening moves of the predator.
To truly understand how a predator successfully takes over a multi million dollar estate right under a family's nose, you have to look closely at the opening moves.
In 2013, an independent caregiver named Esmeralda Gomez entered Joel's life.
To the family looking in from hundreds of miles away, this woman initially seemed like an absolute godsend.
She was checking in on Joelle, helping around the house, driving her to medical appointments, and providing daily companionship.
When you live states away, you breathe a massive sigh of relief when you think your aging parent finally has a reliable local support system.
[00:07:36] Speaker B: But behind that incredibly helpful doting facade, the caregiver was running a textbook, highly calculated psychological playbook.
As we mentioned, dementia often brings a heightened underlying sense of paranoia, vulnerability and confusion.
Instead of grounding the patient and keeping reality stable, a financial predator feeds that growing paranoia.
They weaponize it. They look at the cognitive decline not as a medical tragedy, but as an operational opportunity to rewrite the victim's social circle.
[00:08:16] Speaker A: Charles documented in the caregivers game how this isolation process happens slowly, almost imperceptibly, over a period of years.
It always starts with very subtle, toxic comments the caregiver would whisper to Joelle that her adult children were simply too busy to care about her, or that they only called because they were greedy and waiting for her to pass away so they could inherit her money.
This is standard psychological triangulation.
From my days doing knock and talks on those banking SARs, I saw this exact dynamic repeated constantly.
The predator positions themselves as the only true protector in the victim's life, while actively framing the loving family as opportunistic, distant vultures who. Who don't truly care.
[00:09:08] Speaker B: And the manipulation didn't stop with psychological conditioning.
The caregiver began controlling the physical flow of information.
When Charles or his siblings would call the house, the caregiver would frequently answer the phone and intercept the conversation entirely.
She would make incredibly plausible excuses like, oh, Joelle is resting right now, or she's in the middle of dinner. Let me have her call you back later tonight. But of course, those callbacks never happened. The messages were deleted, the phone logs were wiped, and the family was left wondering why their mother was suddenly becoming distant.
[00:09:53] Speaker A: They were being systematically ghosted by a ghost writer.
Over months and years of this continuous negative conditioning, Joelle's actual perception of reality was completely rewired.
She began to genuinely view her own children, the people who loved her and were actively trying to look out for her as estranged, hostile threats to her personal independence.
The predator didn't stop at the family either. She systematically cut off Joelle's lifelong neighbors, Intercepted her physical mail, Altered her doctor appointments, and eventually became the sole unfiltered lens through which this vulnerable woman viewed the outside world.
[00:10:35] Speaker B: This is the exact phase of the exploitation where the predator becomes completely indispensable to the victim. Once the family is successfully pushed out of the frame and isolated, the caregiver transitions from a domestic helper to into the absolute gatekeeper of the victim's mind, her daily schedule, and ultimately her entire financial portfolio.
It sets the stage for the next phase of the crime where the caregiver moves from emotional manipulation to institutional capture.
[00:11:12] Speaker A: Now, a lot of people listening to behind the scams right now might be thinking, how on earth does a single caregiver get away with this? If a family has professional guardrails in place, it is a completely logical question.
You assume that a long time family accountant, A trusted financial advisor, or an estate attorney would notice major red flags and stop the bleeding immediately, right?
Well, you would certainly think so.
But this specific phase of Charles's story story exposes a massive, terrifying blind spot in our financial and legal systems. A phenomenon investigators call institutional blindness.
[00:11:54] Speaker B: It really is one of the most frustrating aspects of the caregiver's game.
Joelle's family didn't leave her completely unmonitored. They had established highly credentialed professionals handling her affairs.
These were individuals with certified public accountant designations, Traditional stockbrokers at reputable firms, and a dedicated estate planning attorney.
These weren't strangers off the street.
They were seasoned professionals with strict legal fiduciary duties to protect their clients best interests.
Yet Esmeralda Gomez managed to walk right past every single one of those defensive tripwires without triggering a single alarm.
[00:12:46] Speaker A: And you have to look at how she pulled this off, because it is a masterclass in exploiting bureaucratic loopholes.
The predator didn't forge documents in a dark room.
She utilized the victim's own physical presence and legal authority as a bulletproof shield.
When the caregiver wanted to alter an account, move funds, or change a policy, she didn't show up alone. She physically brought Joelle into the bank, the CPA's office, or the attorney's suite. To the professionals sitting behind those desks, they just saw an elderly client making voluntary adjustments to her own portfolio, Accompanied by a deeply attentive, health helpful daily companion who was just assisting her with her mobility.
[00:13:31] Speaker B: They completely Failed to look past the surface level paperwork to see the intense psychological coercion and systematic brainwashing that had been happening behind closed doors for months prior.
When Joelle sat in those offices and verbally confirmed the changes, she was speaking under the heavy influence of the isolation and paranoia the caregiver had planted in her mind.
But the professionals didn't check for cognitive capacity. They didn't ask the caregiver to step out of the room to conduct a private one on one consultation with their client.
They didn't pause to ask why a fiercely independent woman was suddenly transferring massive amounts of control and capital to a non relative who had only been around for a fraction of her life.
[00:14:29] Speaker A: They chose the easy path of administrative compliance over actual investigation.
They relied strictly on the fact that a physical signature was being placed on the dotted line in their eyes. As long as the legal forms were filled out correctly and the client nodded her head, their liability was covered.
This is precisely why those suspicious activity reports I used to investigate were so critical.
Banks would automate the data, but if the human beings inside the branch don't speak up during the physical interaction, the paper trail just legitimizes the theft.
They completely ignored the sudden, drastic deviations from Joelle's long term financial legacy.
They didn't cross check the unusual withdrawal patterns. And they allowed themselves to be entirely pacified by a predator who knew exactly how to play the corporate compliance game.
[00:15:23] Speaker B: Because of that systemic laziness, the professional safety net completely dissolved into thin air.
The very institutions and advisors designed to protect a vulnerable senior's life savings ended up inadvertently rubber stamping the financial exploitation.
They became unwitting accomplices to the crime, entirely blinded by the illusion of a voluntary signature, leaving the estate completely exposed to the final, devastating execution of the trap.
[00:15:57] Speaker A: For nearly a decade, the trap remained completely closed and the illusion of normalcy held perfectly firm across the miles.
Then, in 2022, the timeline fundamentally broke.
Joel passed away.
For Charles and his siblings, the natural crushing sting of losing their mother was instantly compounded by a secondary, deeply shocking trauma that would alter their lives forever.
When they stepped into her physical home to manage her personal affairs, liquidate the estate and find some semblance of emotional closure. They didn't walk into a house of corners, quiet morning. They walked directly into a massive lookalike environment that was actually a meticulously structured forensic crime scene.
[00:16:43] Speaker B: The estate wasn't just slightly altered or impacted by the rising cost of everyday long term senior care.
It was completely, systematically shredded to the bone.
Family heirlooms that had been passed down through multiple generations.
Items of immense sentimental value that Joelle had explicitly promised to her children and grandchildren for decades had completely vanished from the premises.
The jewelry boxes were entirely empty, the safes were cleared out, and the family photographs had been tossed aside.
When Charles started auditing the physical mail, looking at the bank statements and checking the filing cabinets, they found a hidden trail of unrecognized fraudulent credit cards that had been quietly opened in Joelle's name, maxed out to the absolute limit and maintained completely under the family's nose for years.
But the absolute heaviest blow was waiting for them. Inside the legal files, they discovered a brand new will.
[00:17:50] Speaker A: This wasn't a standard modification. It was a total rewrite of her legacy.
This legal document had been quietly executed during the absolute height of Joelle's cognitive decline, During a phase where she was entirely isolated from her biological children and under the complete daily psychological control of the caregiver.
This new document effectively stripped her children of their entire inheritance. And the financial bleeding didn't stop with the real estate or the bank accounts.
They uncovered a massive six figure financial annuity that had been completely liquidated and rerouted, officially naming the independent caregiver, Esmeralda Gomez, as the sole beneficiary of her entire life's work.
[00:18:37] Speaker B: It was a total, flawless financial execution. It was exactly the kind of predatory victory that Charles exposes to in the caregiver's game.
But what makes this story an absolute warning for every single person listening to behind the scams is what happened next.
Charles gathered the banking records, the fraudulent credit card statements, the medical records showing cognitive decline and the highly suspicious new will.
And he took them directly to local law enforcement.
He expected immediate criminal intervention, handcuffs and a police investigation.
Instead, he was hit with a third brutal reality check that left the family completely paralyzed.
The authorities glanced at the mountain of paperwork, saw Joelle's physical signature on the dotted lines, and issued a standard chilling response.
This is a civil matter, not a criminal one. Your mother signed the documents willingly. You'll have to hire a private attorney and fight this out in probate court.
[00:19:50] Speaker A: Think about the sheer weight of that exact moment. Your mother is gone. Her life savings have been completely drained by a stranger. Your family heritage has been erased, and the legal system tells you their hands are completely tied. And because the predator used official legal forms to commit the perfect crime.
From my days doing knock and talks on those banking SARs, I know exactly how crushing this is for families. The system treats a signature as absolute proof of intent, completely ignoring the psychological gun that was held to the victim's head for years.
How do you even begin to fight back when the laws themselves are weaponized against you?
How do you prove that a signature wasn't truly voluntary when the victim is no longer here to speak for herself?
[00:20:37] Speaker B: To fully grasp why our legal and financial architectures fail so completely in cases like Charles mother, we have to look closely at the clinical anatomy of the probate loop.
When law enforcement walks away from a grieving family and applies that same standard sweeping label of a civil matter, they aren't just declining to investigate.
They are essentially handing the predator a massive government sanctioned head start.
In the eyes of the civil court, a physically executed will is legally presumed valid until an outside party can spend tens of thousands of dollars to to prove otherwise in a court of law.
This means Esmeralda Gomez was able to immediately assume administrative control of the estate assets, gain direct access to Joelle's primary bank accounts, and use Joelle's own hard earned life savings to hire high priced corporate defense attorneys to fight off Joelle's own biological children.
Talk about a completely broken system. Adding insult to absolute injury.
[00:21:59] Speaker A: It is the ultimate legal paradox, Sue. And it's a structural flaw that predators count on. They literally use the spoils of the crime to fund their legal defense against the very people they robbed. And as an investigator who spent years digging into these exact patterns, I can tell you that this timeline is entirely by design.
Sophisticated elder financial abusers understand the statutory and operational limits of local police departments and sheriff's offices.
They know that standard property crimes detectives are completely overwhelmed by a relentless backlog of violent offenses, retail theft and street level fraud.
They know that unless there is a blatant amateurish forgery, meaning the caregiver physically signed the victim's name with their own hand, the police will almost always back off and declare it a private contract dispute.
The exact second a predator realizes that psychological coercion and systemic brainwashing are effectively invisible to the criminal justice system.
They recognize that they have been handed a functional, unprosecutable license to steal.
[00:23:12] Speaker B: And they exploit that license to the absolute maximum limit. Charles realized very quickly that he wasn't just fighting an individual bad actor. He was fighting an entire defensive bureaucratic apparatus that protects form over substance. The caregiver hadn't spent those nine years just sitting around.
She had spent that time building a comprehensive page paper trail of administrative compliance.
She had meticulous receipts for minor household expenses. She had signed authorization forms for account transfers. And she had even forced Joelle to write handwritten letters declaring her deep love and complete devotion to her helper. Every single one of those manufactured documents was designed years in advance to be presented to a probate judge. To paint the biological children as distant, uncaring, opportunistic vultures who only showed up after the funeral to collect a check.
[00:24:15] Speaker A: It is a highly calculated narrative flip, and it happens in almost every major elder abuse case I've ever reviewed.
The predator actively attempts to put the family on trial.
They look at the judge and say, where were these kids when she needed her groceries bought?
Where were they when she needed to be driven to her oncology appointments?
They completely omit the fact that they were actively blocking the family's phone calls, deleting incoming text messages, and manufacturing the toxic isolation that kept the family at bay in the first place.
When I used to review those suspicious activity reports from the banking databases, the most deeply frustrating part of the job was seeing that the financial institutions usually knew something was wrong.
Their automated algorithms would flag the unusual activity, the massive wire transfers and the sudden changes in investment profiles.
But because the human beings inside the local branch simply accepted the compliance paperwork and the client's forced nod of the head, the crime was allowed to proceed unchecked for nearly a decade.
[00:25:23] Speaker B: This staggering realization is exactly what forced Charles to abruptly transition from a grieving son into a clinical, hyper focused investigator.
He realized that if he wanted to break the caregiver's game, he couldn't just stand in court and complain about fairness or appeal to emotion.
He was going to have to launch a complete multi front counter investigation to expose the underlying infrastructure of the manipulation.
He had to prove to a legal certainty that the immaculate compliance trail was a complete sham built entirely on top of a vulnerable decaying mind that was no longer capable of protecting itself, understanding reality, or anticipating the consequences of its actions.
[00:26:31] Speaker A: But think about the sheer vertical structural mountain he was facing, Sue. How does an adult child gather viable forensic evidence after the main witness, the victim herself, is already gone?
How do you dismantle a multi million dollar asset structure, stripping conspiracy when the local police have completely turned their backs on you? The bank files are locked behind ironclad privacy walls and the predator is holding all the cash.
That is the terrifying, isolating reality that thousands of families wake up to every single year.
They realize that the institutions they trusted to act as tripwires, the CPAs, the brokers, the estate lawyers and the civil courts, are actually built to protect the paperwork, not the person.
[00:27:21] Speaker B: It is a total architectural failure of trust.
The system is Fundamentally designed to assume that if a form is signed, witnessed and stamped by a notary public, it represents the absolute uncoerced truth of a human soul.
It completely lacks the emotional intelligence, the staffing, or the specialized investigative depth to see the invisible toxic strings of undue influence being pulled in the dark.
Esmeralda Gomez knew exactly how to pull those strings to isolate Joel, leaving Charles and his family with a completely shredded estate, an empty childhood home and and a mountain of compounding legal bills just to get a basic foot in the door of a probate courtroom.
[00:28:17] Speaker A: And that brings us to the edge of the cliff.
This is where the first half of our investigation ends, but it is exactly where the real grueling war begins.
How do you prove cognitive incapacity retroactively when the body has been laid to rest?
How do you trace millions of dollars in liquid assets that have been systematically laundered through shell bank accounts and complex insurance annuities designed to hide the paper trail that is the brutal high stakes legal battlefield we are stepping into?
[00:28:50] Speaker B: This is just the beginning.
Remember, this is the first part of our special exclusive two part series here on behind the Scams covering the caregiver's game.
Next week in the massive conclusion, we are moving entirely out of the trap and directly into the reckoning.
We are going to take you step by step inside Charles's grueling multi year forensic war to break that fraudulent will and reclaim his mother's legacy.
